Umm, Where exactly do you get the information that wardriving is a federal
crime? or even a local crime.

I could see trespassing, if you were physically on the property of the
location.

Warchalking is aimed more at consenting networks, people who are
interested and willing for you to use a little bit of their network.

Wardriving, and sniffing the network are two totaly differnt things.  One
is noteing a location, the other is collecting data from the network.

IMHO this is how it settles out:
	No WEP, DHCP gives an IP to anyone:	If you get a route out,
you could probably get away with a quick ssh session to check your email.

	No WEP, but DHCP not setup:		Note it, possibly find a
way to warn the admin, but forget using it

	WEP enabled:				Don't even think of
touching it.
