Possibly not (these are stock kernels):

CONFIG_UNIX98_PTYS=y

for both kernels but only:

CONFIG_LEGACY_PTYS=Y
CONFIG_LEGACY_PTY_COUNT+256

is only for the 2.6.17 kernel that works.  Why should this have changed 
for stock Debian kernels?
